1. The agreement
These terms govern your use of bugleassessments.com and the Bugle service, provided by Bugle(“Bugle”, “we”). By signing in or using the service you accept them. If your department has a signed agreement or order with us, that agreement governs your department’s use and prevails over anything here.
2. Accounts
- A department’s administrator creates the accounts for its staff and candidates. Use only the account you were given.
- Keep your password and your authenticator to yourself. If you think someone else has used your account, tell your department and us straight away.
- We may suspend an account to protect the service or an examination, and will tell the department why.
3. Examination integrity
A promotional examination is confidential until the department releases it. You must not:
- copy, record, photograph, share or discuss examination content — questions, scenarios, answer keys — outside the process;
- let anyone else sit an examination for you, or help another candidate during theirs;
- try to get around the secure client, the clock, or any other control;
- try to see a record, a score or any content you have not been given.
A department may void an attempt, and act under its own rules, where it finds a breach. We keep the records that allow it to.
4. Using the service fairly
You must not interfere with the service, overload it, reverse-engineer it, probe it for weaknesses other than as our security page invites, or use it to break the law.
5. Whose content is whose
- The department’s. Documents a department uploads, questions it writes, its candidates’ records and its examination results belong to the department. It lets us host and process them only to provide the service to it.
- Ours. The software and the content we supply — starter questions, starter simulations with their pictures and voices, and templates — remain ours. A department may use them in its own examinations while its agreement is in force.
- Drafts are drafts. Questions and scenarios drafted with the service’s AI tools must be reviewed by the department, which approves anything used in its examinations and is responsible for that choice.
6. Decisions stay with the department
Bugle provides tools, analysis and records. The department — and whichever body certifies its lists — adopts the examination, decides appeals, certifies lists and makes promotions. Analyses such as the adverse-impact report are information for those decisions, not legal advice.
7. Fees
Fees are set by the department’s agreement or order. Public agencies are invoiced; nothing is charged automatically.
8. Availability
We run the service to be available when examinations are scheduled and plan maintenance around them. Beyond what a signed agreement promises, the service is provided without a guarantee that it will be uninterrupted or free of errors.
9. Liability
To the extent the law allows: the service is provided “as is”; our total liability for any claim relating to it is limited to the fees the department paid us in the twelve months before the claim arose; and neither side is liable to the other for indirect or consequential loss. Nothing here limits liability that the law does not allow to be limited.
10. Ending
A department may stop using the service as its agreement provides. We may end access for a serious breach of these terms. The department’s records are returned to it as its agreement provides.
11. Changes to these terms
We may update these terms. The date at the top changes, and departments are told of any material change before it takes effect.
12. Law
These terms are governed by the laws of the State of Florida, except where a public agency’s agreement with us names the law of its own state.
